Terms of Service

1. Overview

Kinship Labs (“Kinship”, “we”, “us”, or “our”) provides a B2B SaaS platform that enables businesses to manage relationships and communicate with their contacts via SMS and other channels. These Terms of Service (“Terms”) govern your use of our platform.

2. SMS Messaging Requirements

By using Kinship's SMS messaging features, you agree to comply with all applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and carrier guidelines. Specifically, you agree to:

2.1 Consent Requirements

You must obtain explicit opt-in consent before sending any SMS message to a contact. This consent must be:

• Collected via a clear checkbox at the point of phone number collection (not pre-checked)
• Separate from other terms and clearly visible to the end user
• Documented and retained for the duration of the messaging relationship

2.2 Required Opt-In Disclosure

Your opt-in language must include all of the following elements:

• Your business/organization name
• The type of messages the contact will receive (e.g., “customer support messages”)
• Message frequency (e.g., “Message frequency varies”)
• Notice that “Message and data rates may apply”
• Clear opt-out instructions (e.g., “Reply STOP to opt out”)
• A link to your Privacy Policy

You must honor opt-out requests immediately. Kinship automatically processes the following keywords:

• STOP, UNSUBSCRIBE, CANCEL, END, QUIT - Opts the contact out of messages
• HELP, INFO - Sends help information to the contact

When a contact opts out, you may not send further messages unless they explicitly opt back in by texting START, YES, or SUBSCRIBE.

2.5 Prohibited Content

You may not use Kinship's SMS features to send:

• Messages to contacts who have not provided explicit consent
• Messages after a contact has opted out
• Spam, unsolicited marketing, or promotional content without consent
• Content that is illegal, harmful, threatening, or harassing
• Content related to illegal substances, adult content, or gambling (where prohibited)
• Phishing attempts or fraudulent content
• Content that violates carrier guidelines or the CTIA Messaging Principles

2.6 Record Keeping

You are responsible for maintaining records of consent for each contact, including the date, time, and method of opt-in. These records must be retained for at least 5 years and provided upon request.

3. Your Responsibilities

As a user of Kinship, you are responsible for:

• Ensuring all contacts have provided valid consent before messaging
• Complying with all applicable laws and regulations
• The content of messages sent through the platform
• Maintaining accurate and up-to-date contact information
• Responding to opt-out requests promptly
• Indemnifying Kinship against any claims arising from your messaging practices

4. Account Terms

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized access.

5. Acceptable Use

You agree to use Kinship only for lawful purposes and in accordance with these Terms. You will not use the platform in any way that could damage, disable, or impair our services.

6. Termination

We may suspend or terminate your access to Kinship at any time if you violate these Terms, particularly the SMS messaging requirements. Upon termination, your right to use the platform ceases immediately.

7. Disclaimers

Kinship is provided “as is” without warranties of any kind. We do not guarantee uninterrupted service or message delivery, as this depends on carrier networks and other factors outside our control.

8. Limitation of Liability

To the maximum extent permitted by law, Kinship shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the “Last updated” date.
